摘要
商业秘密是重要的创新资源,而商业秘密保护的量化测度研究在中国尚处于起步阶段。法律保护强度对创新行为产生影响,聚焦商业秘密法律保护,系统性构建测度指标体系,有助于厘清中国商业秘密法律保护状况、明确法律、制度完善方向。运用综合评分法,从立法、司法、执法三个层面选取指标进行定量测度。中国商业秘密立法保护体系较为完善,且在初期就已经达到国际一般保护的立法要求,立法保护力度持续提升,反映出商业秘密强保护的立法需要;司法保护总体水平持续上升,司法裁判质量不断提高,但民刑保护强度测度结果存在显著差异,凸显商业秘密刑事案件立案侦查难的问题;行政执法保护力度并未因执法时间的延长而提升,频繁的立法修改增加了执法主体的法律执行学习成本,行政保护强度在先上升后下降的总体趋势中不断波动。完善商业秘密法律保护,应加强法律明确性与可操作性、减少高频次的法律修改、明确商业秘密认定标准并推动商业秘密案件立案侦查环节专业化建设。
Trade secrets are important resources for innovation.Research on quantitative measurement of trade secret protection is in its infancy in China.The legal protection has an impact on innovative behavior.Focusing on legal protection of trade secret and systematically constructing measurement index system can help clarify the legal protection status of trade secret in China and clarify the direction of legal and institutional improvement.The comprehensive scoring method is used to select indicators from the legislative,judicial and law enforcement levels for quantitative measurement.The research fi nds that China's legislative protection system of trade secrets is relatively perfect,and has met the legislative requirements of international general protection in the early stage.The legislative protection strength continues to improve,refl ecting the legislative needs of strong protection of trade secrets.The overall level of judicial protection continues to rise,and the quality of judicial judgment continues to improve,but there are significant differences in the intensity of civil and criminal protection,highlighting the difficulty in filing and investigating trade secret criminal cases.The protection intensity of administrative law enforcement does not increase with the extension of law enforcement time.The frequent legislative amendments increase the learning cost of law enforcement subjects,and the intensity of administrative protection fluctuates in the general trend of rising first and then decreasing.To perfect the trade secret protection system and amend laws and regulations,it is necessary to strengthen the legal clarity and operability,avoid frequent legal amendments,clarify the trade secret identification standards and promote the professional construction of the investigation of trade secrets.
