摘要
结果要素是情节犯中“情节严重或情节恶劣”要件的常见内容。通过对现有司法解释的梳理发现,结果要素大致可分为损失型、伤害型、自伤型、影响型、危险型、后果型六种解释类型。在同一解释类型中,结果要素往往存在表述用语不清、此罪与彼罪界限不明、循环论证逻辑不当,表述用语混乱、部分规定甚至违反刑法责任主义原则等问题。建议严格恪守罪刑法定原则和责任主义原则的立场,做到解释尽量明确,对于造成被害人近亲属伤害或者自伤的情形,可借鉴德日客观处罚条件理论,实现理论自洽。
Result elements are common contents in'serious or wicked circumstances'of the circumstance crime.Through sorting out existing judicial interpretations,the result elements can be roughly divided into six types of interpretation:loss,injury,self-injury,influence,danger and consequence.In the same type of interpretation,the result elements tend to have problems such as vague expression,unclear boundary between this crime and that crime,improper logic of circular argument,confusing expression,and even some provisions violating the principle of criminal liability doctrine.It is suggested strictly abiding by the principle of a legally prescribed punishment for a specified crime and the principle of responsibility doctrine,and making the interpretation as clear as possible.For circumstances causing injury or self-injury to the victim's close relatives,the theory of objective punishment conditions from Germany and Japan can be used for reference to theoretically improve our own.
