摘要
对争议措施是否构成间接征收作出判定,是仲裁庭解决间接征收相关投资争端的前提。利益平衡视角下,其判定关乎对投资者与东道国之间纯粹经济利益归属、私人与国家权益保护等不同维度的利益权衡。目前,仲裁庭判定间接征收的难点在于,如何区分间接征收和规制措施。这主要归咎于判定依据的表述模糊,使仲裁庭欠缺判定基础,以及判定标准的不确定性影响仲裁庭对不同判定要素的考量。较为理想的改善路径是:优化仲裁庭的判定方法,通过构建针对判定标准的比例分析指引、在标准分析中纳入遵从理念、遵循逐案分析的判定原则等方式,促使仲裁庭的判定向利益平衡的方向迈进。
To resolve an investment dispute involving indirect expropriation,tribunals need to judge whether the disputed takings constitute indirect expropriation firstly.From the perspective of interests balance,the trade-off between investors and host states includes different dimensions,such as pure ownership of economic interests,protection of private and state rights.Currently,the difficulty of the tribunals in judging indirect expropriation lies in how to distinguish indirect expropriation and regulatory takings.This is mainly due to the vagueness of the expression of the basis for the judgment,which makes the tribunals lack a basis for judgment,and the uncertainty of the judgment standard affects the tribunals'consideration of different judgment elements.The ideal improvement path is to optimize the tribunals'judgment method and promote the tribunals'adjudication in the direction of balancing interests by constructing the proportional analysis guidelines for the judgment standard,incorporating the concept of compliance in the standard analysis,and following the judgment principle of case-by-case analysis.
