党内法规同国家法律衔接和协调视野下党组政治的现实意义与完善路径

The Realistic Significance and Perfect Path of the Politics of the Leading Party Members’ Group Under the Vision of Cohesion and Coordination Between the Inner-party Regulations and State Laws

摘要党组政治的组织结构、职责任务、履职方式和功能作用都表明了党组政治在处理党内法规同国家法律关系中占有重要位置。党组政治在党内法规同国家法律衔接和协调中的现实意义表现在:党组政治契合了党章与宪法有机统一的宪制结构、保障了政党制度权威同国家法律权威的高度一致、平衡了党内法规与国家法律所映射的党政关系、弥合了党内法规与国家法律在执行环节的制度缝隙。充分发挥党组政治在党内法规同国家法律衔接和协调中的应有功能,还需在推进党组法治建设、规范党组领导立法工作、建立健全党组文件备案审查制度、加强党委对党组意见会议讨论、完善党组决策转化机制等方面做进一步的完善。 The organizational structure,duties and tasks,ways of performing duties and functions of the politics of the leading party members’ group shows that the politics of the leading party members’ group plays an important role in dealing with the relationship between the inner-party regulations and state laws.That is the politics of the leading party members’ groups corresponds to the constitutional structure of the organic unity of the party constitution and the national constitution,guarantees the high degree of consistency between the authority of the party system and the authority of the state law,balances the relationship between the party and government which reflected by the inner-party regulations and state laws,and bridges the institutional gap between the inner-party regulations and state laws in the implementation link.It is necessary to promote the rule of law construction and standardize the legislative work under the leadership of the leading party members’ group,establish and perfect the filing and review system of the leading party members’ group’s documents,improve the meeting discussion of the opinions and perfect the decision-making transformation mechanism of the leading party members’ group,so as to we can give full play to the due function of the leading party members’ group’s politics in the connection and coordination between the inner-party regulations and state laws.
