摘要
黑灰产业不断为暗网毒品犯罪“供粮输血”,亟需加以有效惩治和预防。暗网毒品犯罪黑灰产业具有技术含量高、链条长、合法与非法相交织及分工日益专业化、精细化的特点。必须充分运用刑法现有罪名,科学实施司法解释,适时增加新罪名对其进行惩治。同时,要从预防的角度引导软件开发、售卖企业,互联网金融企业和物流、快递企业有重点地实施合规计划,才能规制黑灰产业,从源头上挤压暗网毒品犯罪存在的空间。
Black and gray industry continues to provide“food and blood”for drug crimes on hidden web,which is in urgent need of effective punishment and prevention.Black and gray industry about drug crime on hidden web is characterized by high technology,long chain,intertwined legality and illegality,as well as increasingly professional and refined division of labor.We must scientifically implement judicial interpretation by making full use of the existing criminal charges,and add new charges to punish them in a timely manner.At the same time,from the perspective of prevention,it is necessary to guide software development and sales enterprises,Internet financial enterprises,logistics and express delivery enterprises to implement compliance plans in a key way,so as to regulate black and gray industry and squeeze the space for existence of drug crimes on hidden web from source.
