摘要
元宇宙与纠纷解决的结合是基于理念和功能的展望,极有可能是民事智能司法突破发展瓶颈和内卷现状的重要契机。我国现阶段的民事纠纷解决面临效率不足与公正弱化的双重危机与严峻形势,元宇宙有望克服案多人少的资源局限、模拟解纷的效果局限、职权主义的体制局限。我国在线纠纷解决机制也面临普及度、真实度和自由度不足的发展瓶颈,元宇宙有望克服程序权利的保障局限、诉讼场景的真实局限、在线诉讼的时空局限。在民事纠纷解决的智能化应用上,元宇宙可以实现主体在诉讼的沉浸式交互、证据以虚拟形态的存证与质证、多元化纠纷解决的智能决策,从根本上打破线下诉讼的天然垄断和传统优势。元宇宙有其自身局限和制度阻力,但可以实现制度和技术的交融。
The combination of metaverse and dispute resolution is based on the outlook of concept and function,and it is most likely an important opportunity for civil intelligent justice to break through the development bottleneck and the internal volume status.At the present stage,civil dispute resolution in China is facing the double crisis and serious situation of insufficient efficiency and weakened justice.The metaverse is expected to overcome the resource limitation of"many cases and few people",the effect limitation of simulated dispute resolution,and the institutional limitation of authoritarianism.China’s online dispute resolution mechanism also faces the bottleneck of lack in popularity,authenticity and freedom,and the metaverse is expected to overcome the limitation of procedural rights’protection,the limitation of realistic litigation scenarios,and the limitation of time and space of online litigation.In the intelligent application of civil dispute resolution,metaverse can realize the immersive interaction of parties in litigation,the deposition and cross-examination of evidence in virtual form,and the intelligent decisionmaking of diversified dispute resolution,which fundamentally breaks the natural monopoly and traditional advantages of offline litigation.The metaverse has its own limitations and institutional resistance,but it allows for the intersection of institution and technology.
