摘要
我国现有中央层面的“校闹”立法主要集中于四个文件,而地方层面的“校闹”立法共有地方性法规和地方政府规章30部。这些法规和规章大体可以分为两类:一类是在学生伤害处理的相关地方立法中涉及“校闹”问题;一类是在学校安全管理的相关地方立法中涉及“校闹”问题。通过对福建省相关地方性法规的分析,可以发现福建省与“校闹”有关的地方立法在立法目的、适用对象、原则、生命教育、法律服务、保险、“校闹”行为、舆情等方面都有待进一步完善。
Currently,there are mainly four central-level documents on the legislation of“school disturbance”in our country,while a total of 30 local-level ones involve local laws and local government regulations.These laws and regulations can be roughly divided into two categories:one is related to“school disturbance”in the relevant local legislation on student injury treatment;the other is in the school safety management related to local legislation.Through the analysis of relevant local laws and regulations in Fujian Province,it can be found that the local legislation related to“school disturbance”in Fujian province needs to be further improved in the legislative purpose,applicable objects,principles,life education,legal services,insurance,“school disturbance”behavior,public opinion and other aspects.
