中小学“校闹”的发生机制与法治疏解

The Mechanism and Reliefof“School Trouble”in Primary and Secondary Schools

摘要 依据“校闹”的危害程度,可以将其划分为民事侵权型、行政违法型和刑事犯罪型三种。“校闹”的产生受学校安全事故处理满意度低激化家校矛盾、家校信任度降低引发信任危机、法律认知度不高造成“闹赔”怪圈、媒体舆论卷入产生“弱者有理”误导与“逆示范效应”等的影响。对此,应健全法规与制度设计,提升事故处理满意度;探索联合惩戒机制,提升媒体公信力;坚持依法裁判,从严惩处刑事犯罪;营造法治氛围,提高法治素养和家校信任度。 The paper defines the connotation of“school trouble”according to the degree of harmful results of the behavior,and divides it into three types:civil tort,administrative illegal and criminal offense.The main reasons for the“school trouble”are the low satisfaction with the handling of safety incidents that intensifies home-school conflicts,decreased home-school trust which leads to a crisis of trust,the lack of legal awareness that creates a vicious circle of“compensation”,and the media and public opinion involvement that results in a misleading information that“the weak is justifed”and“reverse demonstration effect”,etc.To relieve“school trouble”,we should improve the design of laws and regulations to enhance the satisfaction of accident handling,explore the joint punishment mechanisms to enhance the credibility of the media,insist on judging according to the law and severely punish criminal crimes,and create a legal atmosphere to improve the legal literacy and trust between family and school.
