摘要
近年来,欧盟在外国补贴立法方面动作频频。2021年5月,欧盟委员会发布的《关于扭曲国内市场的外国补贴的条例草案》代表了欧盟立法的最新发展,它拟引入新型审查机制来应对外国补贴对欧盟市场带来的扭曲性效应,这表明欧盟的外国投资政策变得愈发保守。该草案的出台不仅会使我国对欧投资面临更复杂和更严苛的审查,还会破坏正常的国际经贸秩序。为此,我国可以从政府和企业两个层面进行应对:政府层面,积极利用WTO争端解决机制,并做好规则谈判工作;企业层面,在加强内部合规审查和投资多元化的同时,也可考虑利用国际投资仲裁维护自身权益。
In recent years,the EU has made a lot of moves on foreign subsidies.In May 2021,the European Commission issued the Proposal for a Regulation of the European Parliament and of the Council on Foreign Subsidies Distorting the Internal Market,which represents the latest development in EU’s legislation.It proposes to introduce a new review mechanism to deal with the distorting effects of foreign subsidies on the EU market,which indicates EU’s more conservative approach in its foreign investment policy.The promulgation of the draft will not only make China’s investment in Europe become more complex and more stringent scrutiny,but also undermine the normal international trade order.To this end,responses can be made from the positions of government and enterprises:At the government level,China should actively use the WTO dispute settlement mechanism and promote the negotiation of related rules with the EU;at the enterprises’level,while strengthening internal compliance review and investment diversification,they can consider making use of the international investment arbitration to protect their rights and interests.
