摘要
行政协议制度引发民法学者的担忧,并对行政协议的识别标准、履行效力以及违约赔偿范围提出质疑。鉴于私法已对意思自治科以诸多强制性限制,文章以国有土地上房屋征收补偿协议为例,指出是否具有市场交易性并非行政诉讼受案范围的识别标准,故认为相关司法解释不当扩张行政协议范围的主张难以成立。因契约属性是行政协议发挥制度优势的创新根基,行政审判应凸显契约权重并注意分类处理;裁判时应对行政优益权之行使进行严格规制,并将违约损害的赔偿范围扩展至履行后的可期待利益。
The administrative agreement system has aroused civil law scholars’concerns,and they have questioned the recognition standard,performance effect,and the scope of liquidated damages of administrative agreement.Considering that private law has imposed many compulsory restrictions on the autonomy course of will,this paper takes the compensation agreement for housing collection on state-owned land as an example,points out whether it has market transaction is not the identification standard of the scope of administrative litigation.Therefore,it is difficult to establish the claim that the judicial interpretation is improper to expand the scope of administrative agreement.Because the contractual attribute is the innovative foundation of the administrative agreement to give full play to the advantages of the system,the administrative trial should highlight the contract weight and pay attention to the classification;in the judgment,the exercise of the administrative privilege should be strictly regulated,and the compensation scope of breach of contract damages should be extended to the expectable interests after the administrative agreement is fulfilled.
