摘要
为提高我国在灾害来临时的应对能力,分析防灾减灾法律的特征及法理价值。通过研究由于自然原因损害人类生活环境的自然灾害类型、特点及其法律属性分析防灾减灾法律建设的必要性,梳理防灾减灾法律的立法背景、基本原则及范畴,推动完善防灾减灾法律法规体系;通过防灾减灾法律的特征分析我国防灾减灾法律存在的问题;探索建设我国防灾减灾法律的有效途径。利用防灾减灾法律正义、秩序、效率、利益价值的研究尽可能推动我国防灾减灾事业的有序高效进行。
In order to improve our country’s ability to respond to disasters,the characteristics and jurisprudential value of disaster prevention and mitigation laws are analyzed.By researching the types,characteristics and legal attributes of natural disasters that damage human living environment due to natural causes,the necessity of legal construction of disaster prevention and reduction is analyzed,and the legislative background,basic principles and categories of disaster prevention and reduction laws and rules are summarized to promote the improvement of disaster prevention and reduction laws and system.Through the characteristics of the law of disaster prevention and mitigation,the problems existing in the law of disaster prevention and mitigation in China are analyzed,and the effective way to construct the law of disaster prevention and mitigation in China are explored.The study of justice,order,efficiency and interest value of disaster prevention and mitigation law can be used to promote the orderly and efficient progress of disaster prevention and mitigation in China.
