摘要
《中华人民共和国民法典》第807条规定的建工价款优先受偿权,旨在揭示发包人未支付工程价款时,承包人可以采取的法律措施,以及与发包人、其他债权人间的关系。优先受偿权的制度构造,不单要维护权利主体的经济地位,也要兼顾发包人、其他债权人的利益。基于法定担保的定性,优先受偿权即可直接适用《中华人民共和国民法典》第十六章的担保物权一般规定。优先受偿权的行使,应符合权利已经发生与尚未消灭两项关键要件。商品房消费者基于买卖合同获得的权利,排除优先受偿权的适用。优先受偿权劣后于执行费用、共益债务,优先于发包人的其他债权。
The priority compensation right of the Construction project stipulated in Article 807 of the Civil Code aims to reveal the legal measures that the contractor can take when the developer fails to pay the project price,as well as the relations to other creditors of the developer.The system structure of the priority right of repayment should not only protect the economical status of the claimer of the right,but also take into account the interests of other creditors of the contract issuer.Based on the qualitative nature of the statutory guarantee,the priority right to compensation can be directly applied to the general provisions of chapter 16 of the Civil Code.The exercise of the the priority compensation right of the construction project should meet the two key requirements that the right has occurred and not yet been eliminated.The right of commercial housing consumers based on the purchase and sale contract excludes the application of the priority compensation right of the construction project.The priority right of repayment is inferior to execution costs and common-benefit debts,and takes precedence over other claims of the developer.
