摘要
为探讨《中欧全面投资协定》能够释放多大的发展潜力,对《中欧全面投资协定》的签订背景和中国外资结构进行分析,对《中欧全面投资协定》的前景和挑战进行研究。研究认为,欧盟和中国是世界上最大的外资流出地和外资流入国,双边投资的潜力巨大,《中欧全面投资协定》就市场准入、公平竞争、可持续发展和争端解决方面作出规定,有利于中国加快构建更加开放包容的市场,形成更为有效的全面开放格局,推动相关领域的技术革新,形成规模经济,以开放促进改革,完善市场监管体系,构建以我为主、合作共赢的国际关系;有助于欧盟构建中欧双方可持续发展的投资关系,平衡双方的投资和贸易关系,使欧盟国家企业业务更具有确定性和可预测性以增强中欧的政治互信,减轻了欧盟国家面临的"美国冲击"。面对国际政治问题的影响,中国需要稳步推行《中欧全面投资协定》的规定,表明自身态度,加快打造法治化、国际化、便利化营商环境,坚持以对话弥合分歧,以谈判化解争端。
In order to discuss how much development potential the China-EU Comprehensive Agreement on Investment(CAI)can release,this paper analyzes the signing background of the China-EU Comprehensive Agreement on Investment and the structure of foreign investment in China,as well as studies the prospects of and challenges brought by the China-EU Comprehensive Agreement on Investment.Research suggests that the EU and China are the world's largest foreign capital outflow and inflow countries respectively,where bilateral investment has huge potential.The China-EU Comprehensive Agreement on Investment's regulations on market access,fair competition,sustainable development and dispute settlement can facilitate China to speed up the construction of a more open and inclusive of market,form a more effective comprehensive and open pattern,promote technological innovation in relevant fields,establish economies of scale,promote reform through opening up,improve the market regulatory system,and build international relations featuring self-oriented cooperation and win-win results.It will also help the EU to build a sustainable investment relationship between China and the EU,balance the investment and trade relations between the two sides,bring more certainty and predictability to the business of EU countries,enhance the political mutual trust between China and Europe,and reduce the"US shock"faced by EU countries.In the face of the impact of international political issues,China needs to steadily implement the provisions of the China-EU Comprehensive Agreement on Investment,demonstrate its attitude,accelerate the building of a law-based,international and convenient business environment,and bridge differences through dialogue and resolve disputes through negotiation.
