摘要
冲突规范在当代国际私法发展进程中需要围绕时代的理念趋势不断改进与优化,以实现二者的适配与融合。私权保护视域下的连结点选择应当遵循"原则+环境+规则"的体系公式。"原则"系指以私权利益保护和维护私法秩序为重的法律价值,其内含秩序价值和正义价值。"环境"是指由国家治理和司法裁量搭建起来的连结点选择的外部环境,其需要在遵循原则的基础上实现与私权自治的有效结合。"规则"是指冲突规范的具体构建,在私权自治的理念下充分尊重当事人的选法自由;在秩序价值的考量下尽可能运用硬性连结点以维护当事人的预见利益;在追求实质正义的基础上,采用最密切联系和有利原则进行规范。同时,在未来还要注重"范围"研究,从根本上实现冲突法规则结构化、体系化的目标。希望通过以上步骤,促成在私权保护理念下涉外民商事法律规则良性发展的愿景,帮助当事人在此框架下自由和幸福地发展,为国际民商事交往秩序的稳定建设助力。
In the development process of contemporary private international law,conflict rules need to be improved and optimized according to the concept trend of the corresponding times in order to realize the compatibility and integration of the two.The selection of connection points in the view of private right protection should follow the system formula of"principle+environment+rules"."Principle"refers to the legal value of protecting and maintaining the order of private law with the interests of private rights,which contains the value of order and justice."Environment"refers to the external environment selected by the connection points built by national governance and judicial discretion,which needs to be effectively combined with the autonomy of private rights on the basis of following the principles."Rules"refers to the concrete construction of conflict norms,which fully respects the parties’freedom of choice under the concept of private autonomy.Under the consideration of the value of order,we try our best to use the hard connection points to maintain the foreseeable interests of the parties concerned.On the basis of pursuing substantial justice,the most closely related and favorable principles are adopted to regulate.At the same time,we should pay more attention to the research of"scope"in the future,and fundamentally achieve the goal of structuring and systemizing the rules of conflict of law.It is hoped that through the above steps,the vision of benign development of foreign-related civil and commercial laws and rules under the concept of private rights protection can be promoted,the parties concerned can develop freely and happily under this framework,and help the stable construction of international civil and commercial exchanges order.
