摘要
环境标准是环境执法有效运行的基本保障。但是,环境标准在行政执法中的适用状况不容乐观,通过典型案例分析和环境行政管理人员访谈,发现环境标准体系自身的缺陷、环境标准在执法文书中表达的缺失、配套机制的缺失、人为适用的失误等因素,是环境标准在行政执法中效力发挥的阻碍。有必要从上述因素入手,采取完善我国环境标准体系、确保环境标准严格执行、健全环境标准的配套措施、将环境标准内容纳入行政处理决定书并实行规范表达等措施,促进环境标准的执法适用效力不断优化。
Environmental standards are the basic guarantee for the effective enforcement of the environmental law. But the application of environmental standards in administrative enforcement of law is not optimistic. Through typical case analysis and environmental administrators interview, this paper found that the defects of environmental standard system, the lack of expression of environmental standards in administrative enforcement documents, the lack of supporting mechanism, human error and so on, are what obstruct environment standards play a role in administrative enforcement of law. It is necessary to improve the environmental standard system, ensure the strict implementation of environmental standards, improve the supporting measures, incorporate the contents of environmental standards into administrative enforcement documents and implement the canonical expression, so as to promote the continuous optimization of the applicable effect of law enforcement of environmental standards.
