摘要
司法精神障碍鉴定的公正处理有利于保护精神病患者合法权益,维护法律公平正义,由于它主要涉及鉴定人与被鉴定人、家属及司法工作人员之间的关系,所以存在着很多伦理问题,应当运用客观公正、尊重以及最小伤害伦理原则进行规制。尤其是针对目前司法精神障碍鉴定领域存在的鉴定人员称职性、鉴定意见涉及终极问题等的问题,可以以伦理原则为指导进行制度改进,提高鉴定人筛选标准,完善"终极问题原则"和"无病推定原则",确保司法精神障碍鉴定制度顺利进行。
Justice of forensic psychiatry authentication is conducive to protect the legal rights of the mentally illed and to maintain legal fairness and justice. Because it mainly involves the relationship between the judicial appraiser and the appraised person, the family members and the judicial staff, there are many ethical issues, which should be regulated by the rule of objectivity and impartiality, the rule of respect for persons and the rule of non-maleficence. In particular, there are some problems in the field of forensic mental disorders appraisal, such as the competence of forensic scientist and ultimate issue involved in the expert opinion. It is necessary to improve the system under the guidance of ethical rules, improve the standards of judicial appraisers, perfect the "ultimate issue principle" and "presumption of not mental disorder", which can ensure the smooth running of the forensic psychiatry authentication.
