摘要
目的探讨精神病人刑事责任能力评定量表(RSCRs)在司法精神病鉴定中的应用和价值。方法对97例鉴定诊断为患精神疾病者的刑事责任能力鉴定案例进行RSCRs评分,与专家鉴定意见对刑事责任能力的评定结果进行比较。结果RSCRs总分与条目11为中等程度相关(P<0.01),总分与其余17个条目均为强或极强相关(P<0.01)。不同刑事责任能力等级间RSCRs评分比较差异有统计学意义(P<0.01)。RSCRs等级划分结果与专家鉴定意见的一致性尚可(Kappa值=0.73,P<0.01)。探索性因素分析提取2个因子,累积贡献率为72.049%。结论精神病人刑事责任能力评定量表在司法鉴定实践中可作为参考工具,但目前仍难以取代鉴定专家评定。
Objective To explore the application and value of the Rating Scale of Criminal Responsibility(RSCRs)for mentally disordered offenders in the forensic psychiatric expertise.Methods Criminal responsibility of patients with mental disorders in 97 forensic psychiatry criminal cases were assessed with the RSCRs,and the results of RSCRs were compared with experts’opinions.Results There was a moderate correlation between the total score of RSCRs and Item 11(P<0.01),and high or extremely high correlations between the total score of RSCRs and the rest 17 items(P<0.01).There existed a significant difference in the total scores of RSCRs among different capacities for criminal responsibility(P<0.01).The RSCRs grading results were in good agreement with the experts’opinions(Kappa=0.73,P<0.01).Two factors were extracted by exploratory factor analysis,and the cumulative contribution rate was 72.049%.Conclusion RSCRs can be used as a reference tool in the forensic psychiatric expertise,but it is still difficult to replace experts’opinions.
