摘要
学界对欧盟《一般数据保护条例》是否创设算法解释权和算法解释权的属性界定仍有争议,有必要重新检视。通过考察算法解释权的基本权利构造,发现其存在权利内容不完整、适用范围不明确、行使程序未建立等问题,权利内容不完整又表现为解释内容缺失、解释标准不完善,由此导致算法解释权在欧盟法律框架下难以有效实施。算法解释权的本土化又将面临可行性、可欲性与必要性的三重困境。我国可以探索以政府监管为主导、在既有法律框架内实施算法规制的路径,不仅契合我国大数据、人工智能产业发展政策,赋予算法技术良性发展的空间,而且可以节省新兴权利实施的经济社会成本,不失为一种理性务实的算法治理中国方案。
It is still controversial whether the GDPR creates the right to an explanation of algorithm and the definition of the right attribute.It is necessary to reanalyze it.Through the investigation of the basic right construction of the right to an explanation of algorithm,it is found that the content of the right is incomplete,the scope of application is not clear,and the procedure of exercise is not established.The incomplete content of the right is manifested as the lack of interpretation content and the imperfect interpretation standard,which leads to its ineffective implementation under the legal framework of the European Union.The localization of the right to an explanation of algorithm will face three dilemmas:feasibility,desirability and necessity.China can explore the path of implementing algorithmic regulation in the existing legal framework with government supervision as the leading role.It not only conforms to the development policy of China’s big data and artificial intelligence industry,but also gives space for the benign development of algorithm technology,and saves the economic and social costs of the implementation of emerging rights.It is indeed a rational and pragmatic Chinese algorithmic governance scheme.
