摘要
最高人民检察院2019年发布的《人民检察院办案活动接受人民监督员监督的规定》中,对人民监督员的监督范围扩大到了四大检察的“十种情形”,但不再允许监督侦查过程,并形成了四种监督模式,改革了人民监督员的工作机制。人民监督员制度转型的时代背景是:人民监督员的原有监督对象已经基本不复存在、人民监督员不应当监督侦查(调查)过程、扩大人民监督员监督范围符合我国检察体制、有利于增加检察工作的公信力。新一轮人民监督员制度改革的问题也很明显:部分监督方式趋同于普通社会监督、监督范围广泛但重点不突出、人民监督员工作机制缺乏规范性。将来,我们应当对人民监督员制度进行改革,以体现人民监督员的参与式监督的地位、强化人民监督员的监督重点、完善人民监督员的工作机制。
In 2019,the supervision scope of the people's supervisors in the provisions has been expanded to the"ten situations"of the four major procuratorates,but it is no longer allowed to supervise the investigation process,forming four supervision modes and reforming the working mechanism of the people's supervisors.The background of the transformation of the people's supervisor system is:the original supervision object of the people's supervisor has basically no longer existed,the people's supervisor should not supervise the investigation process,expanding the supervision scope of the people's supervisor conforms to the procuratorial system of our country,and is conducive to increasing the credibility of the procuratorial work.The problems in the new people's supervisor system reform are also obvious:some supervision methods are similar to ordinary social supervision,the supervision scope is wide but the focus is not prominent,and the working mechanism of people's supervisor lacks standardization.In the future,we should reform the people's supervisor system to reflect the status of the people's supervisor's Participatory supervision,strengthen the supervision focus of the people's supervisor,and improve the working mechanism of the people's supervisor.
