摘要
法官责任豁免制度是实现司法公正的重要制度之一。针对目前实践中法官责任豁免制度存在的问题,可通过提高法律位阶、形成主客一体“行为中心主义”的认定标准、构建司法化的追责程序等完善法官责任豁免制度,维护法官权利、司法公正。
The judge's immunity system is one of the important systems to realize judicial justice.In view of the problems existing in the practice of the system of exemption of judge's responsibility,we can improve the system of exemption of judge's responsibility by improving the legal rank,forming the identification standard of“behavior centralism”with the integration of subject and object,and constructing the judicial accountability procedure,so as to safeguard the judge's rights and judicial justice.
