摘要
《人体轻伤鉴定标准(试行)》(以下简称老《标准》)中创口和瘢痕的鉴定一直存在争议,《人体损伤程度鉴定标准》(以下简称《标准》)并没有彻底解决这些争议。以一例典型案例展开论述,梳理面部损伤的基本概念、争议条款和鉴定时限。总结常见合理的医源性扩创情形,给《〈人体损伤程度鉴定标准〉适用指南》(以下简称《指南》)做了适当补充。此外,还以案例形式分享了头面部跨部位损伤的处理方法,旨在为面部损伤的争议案件提供参考。
The identification of wounds and scars in the Identification Standards for Human Minor Injuries(Trial)has been controversial.The Identification Standards for Human Injury Degrees have resolved some of the disputes since its promulgation,but still some problems have not been resolved.This article discussed with a typical case,sorting out the basic concepts,controversial clauses,and identification time limits of facial injuries.This article summarized common and reasonable iatrogenic expansion scenarios,and made appropriate supplements to the Applicable Guidelines for the Identification Standards of Human Injury Degree.In addition,this article shared the treatment of head and face cross-facial injuries in the form of cases,aiming to provide a reasonable solution for controversial cases of facial injuries.
