摘要
我国已经开启全面建设社会主义现代化国家新征程的时刻,促进残障者的有效社会融入和社会参与至关重要。尽管我国为保障残疾人就业与发展做出了很大的努力,从法律制度和社会观念方面都取得了一系列积极成果,但仍存在立法思路有局限、法律条文操作性不强等一系列问题,建议应以平等保护为核心、国家扶助为本位、促进就业为理念等三个维度出发,贯彻社会模式的立法理念,提高立法层级,完善相关立法,填补立法空缺,加强立法刚性,增进可操作性,同时健全残障者就业扶助机制,完善执法监督机制,健全残障者就业权的司法保障,切实完善我国残障者就业权的法律保障。
Our country has entered a critical stage of building a moderately prosperous society in all aspects.Whether or not we can guarantee practically and effectively the right to labor and employment of the disabled is the key to the success of our course.Although our country has made great efforts to protect the right to employment and development of the disabled,and made a series of positive achievements in the legal system and social concepts,there still exist a series of problems such as limitation in the lawmaking mentality,lack of operability in legal provision.So the author suggests that we should take equal protection as the core,the national assistance as the basic unit,and promoting employment as philosophy.Starting from these three dimensions,we should implement the social pattern lawmaking mentality,enhance the legislative hierarchy,complete related legislation,fill the legislation vacancy,reinforce the inflexibility of legislation,improve the operability,while at the same time strengthen the mechanism of employment assistance of the disabled,improve the mechanism of law enforcement and surveillance,improve the judicial guarantee of the right to labor of the disabled,and practically perfect the legal protection of the right to labor and employment of the disabled in our country.
