摘要
高校教学事故的认定与处理事关教职工的切身利益,应当进行合理的制度设计。通过对上海高校有关教学事故规章制度的考察可以看出:各高校普遍重视规则制定,能够分级分类处理教学事故,并力求程序公正。但也存在教学事故认定范围过宽、处罚过严等问题。为此,需要明确教学事故的内涵,合理确定教学事故的范围,并为教学事故设置必要的减轻、免除处罚事由。
The mechanism of identification and disposal of teaching accidents in the universities is related to the vital interests of the teaching staff,so a reasonable system should be designed.Based on the regulations of the universities in Shanghai,it can be seen that these universities generally attach great importance to the formulation of rules.They can deal with teaching accidents by classification and strive for procedural justice.However,there are also some problems such as too wide scope of identification and too severe punishment of teaching accidents.Therefore,it is necessary to make clear the connotation and denotation of teaching accidents,and to set up the necessary reasons for mitigating and exempting punishment for teaching accidents.
