基于被害人保护的校园欺凌治理——来自日本经验的借鉴和启示

School Bullying Management Based on Victim Protection——Reference and Enlightenment from Japan

摘要 我国治理校园欺凌多以加害人为中心,在认定欺凌行为,预防和救济受欺凌学生等实践方面存在治理困境。同属儒家文化圈的日本形成了针对校园欺凌的综合治理模式,从"感知痛苦"的角度判断是否构成欺凌,颁布《校园欺凌对策推进法》和《重大事态调查指南》,学校积极开展系列预防和安抚工作,社会组织参与对被害人的帮助等。以被害人保护为视角,基于被害人学理论基础,借鉴日本较为成熟的经验,我国治理校园欺凌需要从完善欺凌行为判断标准、制定专门性法律条款,健全调查处置机制,发挥学校安全保障的主体作用,构建社会组织协同治理的局面出发健全校园欺凌治理体系。 Currently,the management of school bullying is mainly centered on offenders in our country.There are some flaws and dilemma in identifying bullying behaviors,preventing and relieving bullied students,which need the government,schools,families and society to solve.Comparing Japanese practices,we can see that Japan,which belongs to the confucian cultural circle,has formed a comprehensive management model for resisting bullying.There are specific legal provisions and investigating procedure in Japan,they judge bullying from the perspective of"perceived pain of bullied students".The school actively carry out a series of prevention and comfort work,and social organizations participate in the assistance of victims,etc.Reflecting on Japan’s reference,it is worth exploring for us to improve our management approach based on the protection of victims by clearing the standards for bullying behavior identification,formulating specialized legal provisions,investigating mechanisms,playing the role of our schools,and creating atmosphere for social organizations to providing assistance.These efforts can contribute to perfecting the construction of system of school bullying management.
