摘要
治理机构是网络谣言治理的组织基础,当前我国网络谣言治理的行政组织模式面临着合法性与合理性的双重困境,优化网络谣言治理的重要进路就是在行政组织层面对网络谣言治理权力的横向配置和纵向配置进行合理界定,在权力源头上保证权力的有效行使,但又不发生权力的滥用。就横向配置而言,既要厘清网络谣言治理中政府规制和市场机制的界限,同时也要改变当前行政机关内部多头管理的现状,实现网络谣言治理的集中统一;就纵向配置而言,要合理界定网络谣言治理中中央机构和地方机构的具体职权,实现两者关系的法治化。
Administrative organization is the basic unit for Internet rumor governance.The current administrative organization mode for the governance of Internet rumor in China is faced with the balance between legitimacy and reasonability.The important approach of optimizing Internet rumor governance is to reasonably define the vertical and horizontal allocation of the power to govern Internet rumors,and to ensure the effective exercise of the power in the source,instead of abuse of power.In terms of horizontal allocation,the boundary between government regulation and market mechanism in Internet rumor governance should be clarified,and the current situation of overlapping management within administrative organs should be changed to realize centralized and unified Internet rumor governance.In terms of vertical allocation,the specific functions and power of central and local institutions in Internet rumor governance should be reasonably defined to realize the legalization of the relationship between them.
