摘要
受教育权是宪法规定的基本权利,也是现代人权体系的重要组成部分。它是人们为了实现自身更好生存发展、实现社会公平公正的重要权利。受教育权既能为个人的自我发展与价值实现提供必要的条件和基础,也能为社会的发展与进步增强丰富的内容与方式。作为基本人权,受教育权具有防御、受益、保障和发展四个方面的基本权能,需要国家履行相应支持、维护、保障、发展和救济的基本义务,才能维护和促进受教育权的实现。
The right to education is a basic right stipulated in the Constitution and an important part of the modern human rights system.It is an important right for people to realize their own better survival and development and realize social fairness and justice.The right to education can not only provide the necessary conditions and basis for individual self-development and value realization,but also enhance the rich content and methods for social development and progress.As a basic human right,the right to education has four basic capabilities:defense,benefit,protection and development.It requires the state to fulfill its corresponding basic obligations in order to safeguard and promote the realization of the right to education.
