摘要
水利益共享已成为解决跨境流域水资源利用问题的有效途径,但仍处于起步阶段。为了对其理论和实践作进一步的解读和阐释,系统概述了水利益共享理论体系,首先阐释了水利益共享的相关概念与内涵,提出了各国合作意愿、利益共识一致、总体利益增加、利益公平分配等水利益共享应用的基本条件。分别从共享模式与实现过程两方面论述了水利益共享在跨境水资源利用中的应用,从利益创造和利益享有的角度提出了5种共享模式:共同维护,共同享有;共同建设,共同享有;建设项目,受益补偿;建设项目,受损补偿;跨区利用,利益补偿。将水利益共享分为利益共享领域判识、利益共享模式确定、成本和利益核算、利益补偿分析4个步骤。
Water benefit sharing has become an effective way to solve the problem of water resources utilization in transboundary river basins,but it is still in its infancy.In order to further interpret and explain its theory and practice,the theoretical system of water benefit sharing was systematically summarized.Firstly,the relevant concepts and connotations of water benefit sharing were explained,and the basic require⁃ments for applications of water benefit sharing were proposed,including willingness of countries to cooperate,consensus on benefits,increase in total benefits,and equitable distribution of interests.Also it discussed the application of water benefit sharing in utilization of transbound⁃ary water resources from the perspective of sharing mode and executing process,and put forward five sharing modes from the perspective of benefit creating and benefit sharing,such as joint maintenance and joint sharing,joint building and joint sharing,projects construction and compensation for benefit,projects construction and compensation for damage.Water benefit sharing was divided into four steps of judgment of benefit sharing field,determination of benefit sharing mode,cost and benefit accounting,and benefit compensation analysis.
