摘要
离婚冷静期是我国民法典所正式确立的一项新制度,旨在通过立法强制性地为协议离婚的男女设定30天的冷静期限来减少生活中的冲动离婚和草率离婚,从而降低我国逐年攀升的离婚率。但也难免存在适用范围未作区分、适用期限缺乏弹性、例外情形缺乏规定以及配套制度不够健全等不足之处。为了使冷静期制度更好地发挥作用,建议从明确适用范围限于危机婚姻、实施弹性适用期限、增加例外情形规定以及建立健全相关配套制度帮助实施等方面做出完善。
The divorce cooling-off period is a new system formally established in China's civil code.It aims to reduce the impetuous divorce and hasty divorce by legislating a mandatory 30-day cooling-off period for men and women who divorce by agreement,thus reducing the increasing divorce rate in China.However,due to the limited time and experience,it is inevitable that the legislator has some shortcomings in the formulation of this system,such as the undifferentiated scope of application,the inflexible period of application,the imperfect supporting system and the lack of provisions in exceptional cases.In order to make the cooling-off period system play a better role,it is suggested that the application scope should be limited to crisis marriage,the implementation of flexible application period,the addition of exceptions,and the establishment and improvement of relevant supporting systems to help the implementation.
