摘要
科技创新能力是大国竞争的制高点。近两年随着中国科学研究进步和科技竞争力的飞速上升,中国已经成为世界科技竞争的主要力量。科研人才是科技竞争中的关键因素,近期美国在科研竞争中以"保护知识产权"和"国家利益"为由,遏制我国科研影响力和人才交流的措施频出,启用多重法律手段进行调查,且不断泛化司法判决的标准,其中具有代表性的案例涉及的人员身份之高、影响范围之广,均是前所未有的。近期的案例判决在法律的选择、适用和执行方面的做法与模式非常值得进行深入研究,有助于我们正确研判未来国际科研合作的前景,及时合理调整科研项目模式,并把我国的海外人才引进制度纳入更加法制化、透明化和国际化的轨道。
The ability of scientific and technological innovation is the commanding height of competition among big countries.In recent two years,with the rapid development of China’s scientific research and technological competitiveness,China has become the main force in the world’s scientific and technological competition.Scientific research talents are the key factor in the competition of science and technology.In recent years,the United States has taken frequent measures to curb the exchange of talents on the grounds of"protecting intellectual property rights"and"national interests",using multiple legal means for investigation,and constantly generalizing the standards of judicial judgment.The representative cases involve the high status of personnel and the wide range of influence,which are unprecedented.The practice and mode of law selection,application and enforcement in recent case judgments are worthy of in-depth study,which will help us correctly judge the future prospects of international scientific research cooperation,timely and reasonably adjust the mode of scientific research projects,and bring China’s overseas talent introduction system into a more legal,transparent and international track.
