摘要
法治思维是规则思维、价值思维和程序思维的结合。法治思维重在应用,需要在治理实践中得到体现。疫情防控是对国家治理能力的一次大考,如何依法防疫是大考中的重要内容。坚持运用法治思维开展疫情防控工作是依法防控的关键。为此需要以规则思维为依法治理筑基,以价值思维定位权利保护的方向并明晰权利限制的界限,以程序思维实现过程正义并推动治理格局与方式的转换。
The mindset of rule of law is the combination of rule thinking,value thinking and procedure thinking.The mindset of rule of law focuses on application,which should be reflected in governance practice.Epidemic prevention and control is a big test for Chinese governments'governance capability while how to prevent epidemic disease by law is the important content in the big test.The key to preventing and controlling epidemic in accordance with the law is to persist in applying the mindset of rule of law in the epidemic prevention and control.Therefore,we need to lay solid foundation for governance by law with rule thinking,position the direction of right protection and clarify the limits of right restriction with value thinking,realize the process justice with procedure thinking and promote the transformation of governance pattern and mode.
