摘要
网络表情包是人们在即时通讯中采用图片、卡通动画、文字等素材制作的具有动态或静态效果的交流工具。随着网络表情包被使用范围的扩大,它逐渐成为谋取经济利益的工具,被侵权现状频繁发生。网络表情包承载着创作者的独特思想,具有独创性,应受到《著作权法》的保护。目前,网络表情包在被使用的过程中存在使用界限模糊、缺乏监督、发布平台未尽义务、侵权成本低、维权成本高等问题。鉴于网络表情包著作权人的权利保护困难,文章提出明确合理使用范围、引进第三方监管、建立审查机制、采用惩罚性赔偿、使用权合理付费等建议,积极促进网络表情包发展的合法化和规范化。
The network expression package is a kind of communication tool with dynamic or static effect,which is made by using pictures,cartoon animation and text in instant communication.Along with the enlargement of the using range of the network expression package,it gradually becomes a tool to seek economic benefits,and is infringed frequently.The network expression package should be protected by the Copyright Law,because it reflects the unique ideas of creators.At present,there are such problems as ambiguous boundary,lack of supervision,unfulfilled obligations of the publishing platform,low cost of infringement and high cost of rights protection in the process of using network emoticons.Owing to the difficulties in protecting the rights of copyright owners of network emoticons,the article puts forward such suggestions as specifying the reasonable use scope,introducing the supervision of third parties,establishing an examination mechanism,adopting punitive damages,paying reasonable fees for the use right and so on,in order to actively promote the legalization and standardization of the development of network emoticons.
