摘要
未成年人最大利益原则需要在具体环境中评估和阐释。在当前的司法实践中,法院通过利益权衡方法评估最大利益并以此确定抚养权的归属,但这一做法普遍面临自由裁量权过大并威胁法的安定性的质疑。对此,可以考虑从抚养纠纷中存在的主、客观要素出发,发现确定抚养权归属中存在共识的基础规则,并以其为基础,在有规整漏洞时推导抚养权归属法律效果评价可以适用的具体规则,从而将利益权衡方法作用于法律效果评价的过程去神秘化,使法律效果评价可予反驳且能经受得住反驳,减少司法恣意,维护法的安定性。
The child’s best interests principle must be evaluated in a specific context. In the current judicial practice, the court evaluates the best interests through the method of balancing interests and determines the custody of children, which generally faces the problem of excessive discretionary power that threatens the stability of the law. In this regard, we can consider starting from the subjective and objective elements in the custody disputes and find the basic criteria for determining the custody. When there are loopholes in the law, specific rules for determining the custody can be derived through these basic criteria. This can demystify the evaluation process of the principle of children’s best interests, make the evaluation of legal effects rebuttable and may withstand rebuttal, and maintain the stability of the law.
