摘要
随着互联网技术的蓬勃发展,电子商务交易的范围不断扩大,已经逐渐形成一个完整的市场体系,但电子商务交易竞争激烈,许多网络经营者为了谋求更多的交易机会,恶意利用虚假宣传等手段,侵害了行业经营者的公平竞争权,损害了消费者的合法权益,扰乱了市场竞争秩序,因此需要对网络虚假宣传行为进行规制。而目前网络虚假宣传行为的界定、监管部门的职责、司法管辖权限等不够清晰明确,本文就网络虚假宣传行为进行系统分析,通过对网络虚假宣传行为概念以及特征的解读,明确网络虚假宣传行为的界定,并就目前我国网络虚假宣传行为法律规制存在的问题提出一些完善的意见,以期促进我国市场经济有序发展。
With the rapid development of Internet technology in recent years,the scope of e-commerce transactions has been expanding,and a complete market system has been gradually formed.Due to the characteristics of Internet,such as high efficiency,large audience,fast transmission speed,and the rapid updating speed,the competition among operators of network transactions is fierce.In order to seek more trading opportunities,many network operators maliciously use false propaganda to crack down on the fair competition right of business operators in the same industry,infringe on the legitimate rights and interests of consumers,and disrupt the market competition order.Therefore,it is necessary to regulate the network false propaganda behavior.At present,China's existing network legal system is not very sound,has not yet formed a perfect network legislative system,the definition of network false propaganda behavior,the responsibilities of regulatory authorities,jurisdiction and other issues are not clear enough.This paper makes a systematic analysis of the network false propaganda behavior,through the interpretation of the concept and characteristics of the network false propaganda behavior,defines the network false propaganda behavior,and puts forward some perfect opinions on the problems existing in the legal regulation of the network false propaganda behavior in China,so as to promote the orderly development of China's market economy.
