摘要
竞争中性原则是推进我国市场经济深入发展的重要指针,其核心意涵在于反对政府及其部门对市场竞争的歧视性干预,其价值目标则在于推进市场公平竞争机制的有效实现。为了更加有效地推进竞争中性原则的具体实施,必须奉行竞争中性法治化路线,强化系统性经济法治建设。其具体法治化实现路径包括以下三个方面:以专门竞争中性立法的构建为中心推进经济立法制度、以市场竞争监管行为的规范为中心推进经济执法制度、以市场主体公平竞争权的实现为中心推进经济司法制度。
The principle of competition neutrality is an important indicator to promote the in-depth development of China's market economy.Its core meaning is to oppose the discriminatory intervention of the government and its departments in market competition,and its value goal is to promote the effective realization of market fair competition mechanism.In order to more effectively promote the specific implementation of the principle of competition neutrality,we must resolutely pursue the route of the rule of law in competition neutrality and strengthen the construction of a systematic economic rule of law.The specific realization path of the rule of law includes the following three aspects:the promotion of the economic legislation system centered on the construction of special competition neutral legislation,the promotion of the economic law enforcement system centered on the regulation of market competition regulatory behavior,and the realization of the fair competition rights of market subjects as the center promotes the economic justice system.
