摘要
在网络信息化和技术转型背景下,网络交易安全日益受到监管部门的重视。民商法旨在维护平等与自由的市场运行秩序,通过设置虚拟网络交易过程中的基本法规来约束相关市场主体,切实防范和杜绝侵害平台消费者正当权益的行为。对于网络交易安全,应当给予立法层面的监管,因而需要民商法提供最根本的立法规范支撑。基于此,本文探讨了网络交易安全中民商法的价值,并结合民商法在网络交易中的具体实施状况及应用要点,探析了民商法的完善措施,进而提出了健全民商法的规范制度体系、严格维护网络交易中的信息数据隐私安全等具体措施。
In the context of information technology and technological transformation,the security of network transactions has been paid increasing attention by the authorities.The civil and commercial law serves to maintain the market order of equality and freedom,to restrain market players by stipulating legal rules of carrying out network transactions,and to effectively prevent the acts that infringe upon the legitimate rights and interests of consumers.Meanwhile,online transactions should be regulated at the legislative level,and thus requires legislative support of the civil and commercial law.Based on this,this paper discusses the role of the law in the protection of network transaction security,and explores the perfection measures in combination with its implementation status and application points,and then makes some recommendations such as improving the regulatory system of the law and maintaining the security of information and data privacy.
