摘要
从目前的教育法律实践来看,区分教师惩戒与体罚或变相体罚行为的法律困难性主要体现在概念上的模糊性、实践上的复杂性以及制度上的缺失性。因此,区分教师惩戒与体罚不能仅仅依靠概念界定等法学方法,还必须有一套可操作的、实践性强的法律方法,具体来说就是从强调后果性到强调动机性、从实体性正义到程序性正义、从禁止性规范到授权性规范。从司法审查角度来说,对教师惩戒行为的正当性审查应当主要侧重于对其目的上是否具有教育性、实体上是否遵循比例原则以及程序上是否规范等方面。
From the current practice of educational law,the difficulties in distinguishing the legal boundaries of teachers'disciplinary measures and corporal punishment or disguised corporal punishment is mainly reflected in the ambiguity in concept,the complexity in practice and the lack of system.Therefore,to distinguish the legal boundaries between teachers'disciplinary measures and corporal punishment should rely not only on defining legal concepts,but also on a set of practical and operational legal measures,which shift the emphasis from motivation to consequence,from substantive justice to procedural justice,and from prohibitive norms to authorized norms.prohibitive norms to authorized norms.From the perspective of judicial review,the judgement of the legitimacy of the teachers'punishment behavior should be made mainly on the basis of whether the purpose is educational,whether the principle of proportionality is substantively followed,and whether the procedure is standardized.
