摘要
保障特殊儿童受教育权争议得到妥善解决,是实现公平、有质量的特殊教育的重要一环。鼓励协商和具体可行的程序能有效解决相关纠纷。本文旨在介绍2004年《障碍者教育促进法》修正案中程序保障(Procedural safeguards)政策所规定的争议解决程序,探析美国特殊儿童家长和学区公立教育机构如何解决特殊儿童受教育权的纠纷问题,尝试分析争议解决程序的特点及不足,以期为我国特殊教育争议解决制度的完善提供可借鉴的经验。
Properly resolving disputes to guarantee the right of education for children with special needs is an important part of achieving fair and quality special education.Encouraging negotiation and establishing feasible procedures can be conducive in this regard.This paper aims to introduce the American dispute resolution procedure in the procedural safeguards in the Individuals with Disabilities Education Improvement Act of 2004,analyze how parents of children with special needs and public educational institutions in school districts resolve disputes over the right to education for children with special needs as well as the characteristics and shortcomings of the dispute resolution procedure,with the purpose of improving the special education dispute resolution system in China.
