摘要
农业品牌培育是实施乡村振兴战略的重要措施,知识产权是农业品牌确权的基本工具,是农业品牌的创制、管理和运营的重要路径。虽然我国知识产权法制体系已经形成,但是在农业品牌培育方面仍然存在许多问题,如生物遗传资源、动物新品种、植物新品种、地理标志、民间文学艺术作品、产地、字号等关涉“三农”的特别知识产权类型不明确。为此,乡村振兴战略下需要对农业品牌培育的知识产权路径进行梳理和优化,明确关涉“三农”的特殊知识产权类型,健全涉农知识产权法治和管理,引导农业主体有效经营知识产权,以加速农业品牌的培育。
The cultivation of agricultural brand is an important measure to implement the strategy of Rural Revitalization.Intellectual property is the basic tool to confirm the right of agricultural brand,and an important path to the creation,management and operation of agricultural brand.Although the legal system of intellectual property in China has been constructed,there are still many problems in the cultivation of agricultural brands,for example,such things as biological genetic resources,new animal varieties,geographical indications,folk literature and art works,origin,brand name and other special types of intellectual property related to"agriculture,rural areas and farmers"are not clear.Therefore,under the strategy of rural revitalization,we need to sort out and optimize the intellectual property path of agricultural brand cultivation,clarify the types of special intellectual property related to"agriculture,rural areas and farmers",improve the rule of law and management of agricultural intellectual property,guide the agricultural subjects to effectively manage intellectual property,so as to accelerate the cultivation of agricultural brand.
