人工智能视域下劳动法困境及对策研究 被引量:7

摘要 人工智能为社会发展带来了机遇和挑战。人工智能的广泛运用,创新了社会的发展形态。人工智能的产生使劳动法陷入了理论和实践的困境,包括劳动法律主体资格存疑、劳动安全卫生制度失灵、就业替代和行业取代、冲击劳动基准体系、突破解雇保护制度等潜在危机,因此劳动法律制度需要作出反应以应对这些挑战。人工智能视域下劳动所呈现的新特征,突破了传统劳动法理论和实践的范畴,给劳动法带来了挑战和困境。为此,劳动法律制度应当从调整劳动关系从属性理论、加强人力资源投资、完善就业促进政策、完善社会保障和收入分配制度等几个方面作出应对,以重构法律规则和法律制度,解决理论和实践的难题。 Artificial intelligence has brought opportunities and challenges to social development.The extensive application of artificial intelligence has created the development form of the society.Theory and practice of labor law sinks into the predicament by the generation of artificial intelligence,including labor law subject qualification in doubt,employment,failure of labor safety and health system,potential crisis such as alternative and industry substitution,the impact of labor standards system,breaking through the fire protection system,so labor legal system needs to respond to these challenges.The new characteristics of labor from the perspective of artificial intelligence break through the category of traditional labor law in theory and practice,and bring challenges and difficulties to labor law.Therefore,the labor legal system should respond to the aspects of labor relations attribute theory,strengthen human resource investment,perfect employment promotion policy,social security and income distribution system,so as to reconstruct the legal rules and legal system and deal with the theoretical and practical problems.
