摘要
乡规民约是乡村社会维护社会治安、调解民间纠纷、处理公共事务、实现村民自治,由村民共同商议、共同制定、共同遵守的行为规范。乡规民约是创新乡村治理的有效载体,是涵养新时代新风正气的催化器。乡规民约在乡村治理中存在的主要障碍是:在部分地区存在超越法律现象,在制定和执行过程中存在冲突,乡规民约作用的发挥存在结构性障碍。乡规民约具有乡村社会秩序生成的功能,是乡村治安秩序治理的规范,是乡村社会解决民间纠纷的机制,是乡村社会治理的重要保障。
Village rules and regulations are the code of conduct for maintaining public order,mediating civil disputes,dealing with public affairs,and realizing villagers'autonomy.Village rules and regulations are the effective carrier of innovative rural governance,and are the catalyst for the new ethos in the new era.The main obstacles in the rural governance of village rules and regulations are:In some areas,there are phenomena of exceeding the law,conflicts in the process of formulation and implementation,and structural obstacles in the role of village rules and regulations.Village rules and regulations have the function of generating rural social order,which is the norm of rural public security order governance,the mechanism of solving civil disputes in rural society,and the important guarantee of rural social governance.
