摘要
个人信息安全在大数据时代面临着严峻的挑战和风险,个人信息保护工作也已经提升到国家战略的高度。维护个人信息安全已经刻不容缓,但现有的个人信息保护制度面临着立法、执法和司法方面的困境。个人信息权利被大规模地侵犯已经达到了损害社会公益的程度,以行政公益诉讼制度的全面落实为契机,将行政公益诉讼制度引入个人信息保护领域能够更有效地保护个人信息权利,回应人格利益保护的现实需求。信息行政公益诉讼制度之实践,需要在行政公益诉讼的适用范围、起诉条件、诉前程序规则以及相关配套机制等方面予以创新和完善,信息行政公益诉讼制度的建构能够更有效更全面地保护个人信息。
Personal information security is facing severe challenges and risks in the era of big data,and personal information protection has been elevated to the height of national strategy.It is urgent to maintain the security of personal information,but the existing personal information protection system is facing difficulties in legislation,law enforcement and justice.The massive infringement of the right of personal information has reached the extent of harming social welfare.Taking the full implementation of the administrative public interest litigation system as an opportunity,the introduction of the administrative public interest litigation system into the field of personal information protection can more effectively protect the right of personal information and respond to the actual needs of the protection of personality interests.The practical application of the information administrative public interest litigation system requires innovation and improvement in the scope of application of administrative public interest litigation,the conditions for prosecution,pre-litigation rules and related supporting mechanisms,etc.The construction of the information administrative public interest litigation system can protect personal information more effectively and comprehensively.
