摘要
高考法律治理是高考治理体系与治理能力现代化的必要基础和重要依托。高考法律治理的价值目标是保障实现高考的核心功能,兼顾高考的科学性与公平性,协调相关主体的利益关系。目前高考法律治理在治理依据、治理主体、治理工具、治理程序等方面面临困境。为了保障和发挥高考法律治理的作用,应健全高考法律制度体系,构建多方参与的协同治理机制,强化标准管理和质量控制,完善高考改革的决策、执行和监督程序等制度安排和实现方式。
The legal governance is the necessary foundation and important support for the modernization of college entrance examination governance system and governance capacity.Its value objectives are to ensure the core function of college entrance examination,taking account of its scientificity and fairness and coordinating the stakeholders.Now,there’s predicament at the aspect of governance basis,governance subject,governance tool and governance procedure.To safeguard and play the role of legal governance,it should improve the legal system of college entrance examination,build a multi-participatory collaborative governance mechanism,strengthen standard management and quality control,and improve the decision-making,implementation and supervision procedures of college entrance examination reform.
