摘要
立法机关自上世纪末即在《消费者权益保护法》中引入惩罚性赔偿机制,但这一机制施行中的纷争与探讨从未停歇。在其法律实施中存在种种乱象:司法维度长期以来同案不同判;行政维度则过度规制惩罚性赔偿维权主体。惩罚性赔偿法律实施的乱象根源在于司法机关与行政机关对惩罚性赔偿理念与规范预期的裁判偏差和规制错位。为克服这一机制的运行困境,使惩罚性赔偿的法律实施达致更优,司法机关应当将一般消费领域与食品消费领域区分,一般消费领域的案件裁判应当以“三要件”欺诈认定模式为核心;行政机关则应当转变规制思路,以类型化处理消费维权行为为基础实现与司法机关的协同规制。
At the end of the last century,the legislature introduced the punitive compensation mechanism into Law of the PRC on the Protection of Consumers’Rights and Interests,but the debate over its implementation never ceases.There is much chaos in the implementation:different sentences for the same case in the judicial dimension,and the over-regulation of punitive damages subject in the administrative dimension.The cause of the chaos lies in the judicial and administrative organs'judgemental deviation and regulatory dislocation concerning the idea and expectation of punitive compensation.In order to optimize the implementation of punitive compensation law,judicial organs should distinguish general consumption from food consumption,and administrative organs should change their way of thinking and perform collaborative regulation with judicial organs based on the typification of consumer rights protection.
