摘要
党政合设合署是时代境域之必然,是应对社会主要矛盾转变之时势所需。党政合设合署后,面临对外权力行使的问题,主要集中在对外权力行使的名义、范围和程序。目前,学界在党政合设合署后对外权力行使的程序问题上,研究匮乏且远远滞后于实践。党政合设合署,在对外权力行使时均应依照一定的程序,实现权力有序、有效运行。在党政合设外部权力运行方面,扩大“行政”或者“行政履行任务”的内涵,将行政权力的实际运行纳入行政程序的范畴,依照相关程序加以规制。在党政合署外部权力运行方面,应采取效果要件和实质要件加以认定,避免行政机关的虚化。
The co-establishment and co-location of Party and government is the necessity of the times,and also the need of current situation to deal with the change of principal social contradictions.The problems of exercising the power externally,after the co-establishment and co-location of Party and government,focus on issues like in whose name the power is executed,the scope and procedure of the execution.Presently,study on the procedure in the academia is scarce and far behind the practice.Exercising power externally should follow certain procedures to ensure the orderly and effective operation of the power.In the external power operation of the co-establishment of Party and government,the connotation of“administration”or“administrative performance task”should be extended,putting the actual operation of the administrative power into the scope of administrative procedure and regulating it with relative procedure.In the external power operation of the co-location of Party and government,effect factors and substance factors should be adopted to confirm the operation so as to avoid the nonentity of the administrative units.
