摘要
"例外状态"俨然已成为当今国际政治理论研究的热门词,但研究者们并未对其概念做出详尽的解释,直至阿甘本《例外状态》的出版。法哲学结构中的例外是通过悬置法律,使主权者处于法律之外与法律之内的模糊地带。如何清晰地限定地带的边界,应追溯到马基雅维利(NiccolòMachiavelli)、施密特(Carl Schmitt)和本雅明(Walter Benjamin)对"例外状态"的阐释。只有理清"例外状态"与法律的关系,从"例外状态"逐渐常规化的视阈下探讨人如何避免沦为赤裸生命,打破"例外状态"的生存空间,才能实现人类的整体解放。
The concept of " State of Exception " has become a hot word in the study of international political theory, but researchers have not explained its concept in detail until the publication of Giorgio Agamben’s " State of Exception ". Exceptions in the structure of philosophy of law lie in the ambiguous zone outside and inside the law by suspending the law. How to clearly define the boundary of the zone should be traced back to Niccol Machiavelli,Carl Schmitt and Walter Benjamin’s interpretation of the state of exception. Only clarifying the relationship between the exceptional state and the law, and explore how to avoid becoming naked life and break the living space of "exceptional state" from the perspective of the gradual normalization, can we explore how to avoid being reduced to naked life and break the living space of the exceptional state.
