摘要
在全球治理的背景下,面对国际社会现实和困境,中国提出了人类命运共同体理念。这一理念吸收了康德永久和平思想、中国传统和谐思想和国际法共同体理论的合理部分。和谐价值影响了命运共同体中的国际法主体、国际法规则;命运共同体的构建对和谐价值的作用则是通过国际法主体制定、适用、执行国际法规则显现出来的。人类命运共同体的构建与和谐价值之间具有互动作用。在与和谐价值的互动中构建人类命运共同体,国家应协调多方利益,承担对国际社会的整体义务,而国际组织应当发挥缔结条约、解决国际争端的作用。
In the context of global governance,facing the reality and predicament of the international community,China has proposed the concept of a community of shared future for mankind.This concept absorbs the rational parts of Kant’s thoughts of permanent peace,the Chinese traditional thoughts of harmony and the community theory of international law.The value of harmony affects the subject of international law and the rules of international law in a community of shared future;the role of the construction of a community of shared future in the value of harmony is manifested through the formulation,application and enforcement of the rules of international law.An interaction exists between the construction of a community of shared future and the value of harmony.To build a community of shared future in the interaction,the state should coordinate multi-party interests and assume obligations for the international community,while international organizations should play the role of concluding treaties and solving international disputes.
