新中国70年教育法治的回顾与前瞻 被引量:10

Retrospect and Prospect of Rule of Law in Education of China in the Past 70-Year

摘要 新中国成立以来,我国的教育法治建设取得了辉煌的历史性成就,实现了从教育法制向教育法治的时代转型。时至今日,我国的教育立法已初具体系,教育行政领域基本形成了多元参与的治理机制,教育司法实践在制度的保障下迅速发展。然而,必须承认的是,当前的教育法治建设还存在着立法理念有所滞后、执法力度尚显不足、司法裁判标准不一等一系列问题。在新时代新形势下,有必要立足国情,对我国教育法治事业的发展作出客观理性的前瞻,对教育立法、行政、司法的全面推进提出可行之策。 Since the founding of the People’s Republic of China, the construction of rule of law in China’s education has achieved brilliant historical achievements. And the transition from rule by law to rule by law in education has been already completed. Up to now, China’s educational legislation has initially formed a certain system, a multi-participation governance mechanism has basically formed in the educational administration field, and the practice of educational justice has developed rapidly under the guarantee of the related system. However, it must be acknowledged that the current construction of rule of law in education still has a series of prominent problems, such as the lag of the legislative concept, the lack of law enforcement, and inconsistent standards of judicial adjudication. Under the new era and new situation, it is necessary to make objective and rational prospects for the development of rule of law in education based on China’s national conditions, and propose feasible measures for the comprehensive promotion of legislation, administration, and justice in education.
