摘要
我国中小学与未成年学生的法律关系呈现出公私法属性并存的混合样态,学校保护义务也因此呈现出多样的渊源。我国学校保护立法经过了从开端、奠基,再到不断发展完善的阶段,目前表现出精细化立法的发展趋势。应尽快完成学校保护立法的体系化,提升学校保护立法体系的外部体系规范性与内部价值融贯性。
The legal relationship between primary and secondary schools and minor students in China presents a mixed state of public and private law attributes,which decides the various origins of the schools'obligation to protect minor students.China's school protection legislation has gone through the stages of starting,laying the foundation,improving,and it is currently developing in a increasingly detailed trend.Specialized legislation for school protection should be completed soonly to enhance the external system normnativeness and internal value coherence of the school protection legislative system.
