摘要
教育法典的编纂需要充分考虑现行教育法律体系的制度基础与教育治理现代化的发展需要。本研究使用社会网络分析方法,以教育法律关系主体为观测点,对8部现行教育法律所构建的教育法律体系的治理特征进行分析。结果显示,当前教育法律突出地以学校教育为调整重心,对于其他教育形式的规定相对薄弱;法律条款中各法律关系主体的协作程度不高,对不同主体的分类管理和系统规范亦存在改进空间。在当前法制基础上进行教育法典的编纂研究,需要以助力教育现代化为重要功能定位,积极回应教育实践格局的发展变化。
The compilation of education code needs to fully consider the current education legal system as the institutional basis,and accord with the realistic needs of the modernization of educational governance.Using the method of social network analysis and taking the subject of educational legal relationship as the observation point,this research analyzes the governance structure of the current educational legal system constructed by eight existing education laws.The results show that the current education law focuses on school education prominently,however the provisions for other forms of education are relatively weak;the cooperation among the legal relationship subjects is not widespread;the classified management and the systematically regulation of different subjects are also need to improve.Based on the current legal system,the research on the compilation of education code needs to take helping the modernization of education as the important function orientation,and actively respond to the development of the pattern of educational practice.
