劳动争议案件中电子数据证据认定的规范化——以第三方支付工具为对象

摘要 目前我国有关电子数据证据的规定数量较少,存在着电子数据证据在劳动争议案件中认定比较随意的现象。第三方支付工具应用的普遍化增加了劳动争议案件中电子数据作为证据使用的难度。出现了小微企业中出现频次高、作为证据使用的审查与判断困难以及电子数据证据认定标准不一的问题。通过规范小微企业的管理、电子数据证据的使用规则以及增强劳动争议裁判者的能动性,以此促使电子数据证据在劳动争议案件中作为证据使用认定的规范化。 At present,there are few regulations on electronic data evidence in China,and there is a phenomenon that electronic data evidence is relatively random in labor dispute cases.The generalization of third-party payment instrument applications has increased the difficulty of using electronic data as evidence in labor dispute cases.There have been problems in the small and micro enterprises that have high frequency,difficulty in reviewing and judging as evidence,and different standards for electronic data evidence.By regulating the management of small and micro enterprises,as well as the rules for the use of electronic data evidence,and enhancing the initiative of labor dispute referees,electronic data evidence is used as a standardization of evidence use in labor dispute cases.
